Important cases and claims
Ken, a WWII veteran, worked as a painter in Sydney in the mid-sixties. For 20 years, his work required that he sand down asbestos cement sheeting which formed the exterior and interior linings of Housing Commission Homes and Municipal Buildings. Ken was diagnosed with mesothelioma in 2012 and Shine filed proceedings in the NSW Dust Diseases Tribunal against the defendant the same year. Six months later, at the age of 93, Ken’s claim was successfully resolved in the lead up to trial.
Charles instructed the Shine team at 83 years of age following his diagnosis of mesothelioma and a life expectancy of 6-12 months. His asbestos exposure occurred while working as an apprentice fitter and turner in Queensland for Foggett Jones (JC Huttons) in the 1960s. His work required that he tie cord rope around steam pipes and gaskets, with each of these materials containing asbestos. Shine secured a settlement within a two month period – an outcome that provided Charles with comfort in knowing that his disabled wife would be cared for upon his passing.
Herman was diagnosed with an asbestos-related disease in 2014 at the age of 69. Herman did little more than handle and cut asbestos sheeting while building an extension to his family home in Cabramatta West in 1975. Once identifying the manufacturer of the sheeting, Shine filed court proceedings and secured a settlement via negotiations. As a result, Herman recovered damages in excess of half a million dollars.
Ian was a 75 year old retiree when he was diagnosed with mesothelioma. His asbestos exposure occurred roughly 40 years prior, whilst working on and within close proximity of steam lines at the now defunct Rockhampton Power Station in Queensland. Workers would remove and replace asbestos lagging on steam pipe and lines and also on other plant at the power station. Consequently asbestos fibres were liberated into Ian’s work environment, Shine’s Asbestos Litigation Team obtained numerous statements from other former workers at the power station who came forward to help the team secure a six figure settlement for Ian within a matter of weeks.
